Land EMI operates solely as a technology platform and service provider. We do not engage in land sales, land allotment, loan disbursement, or any other land-related activity. This disclaimer sets out the scope of our role and the responsibilities of users of the Platform.
1. Our Role — Platform Service Provider Only
Land EMI is a software platform that provides digital tools for users to track and manage land-related transactions that they enter into with third parties of their own choice. We are not a real-estate developer, promoter, broker, lender, NBFC, escrow agent, or land-allotment authority. The Platform does not act as principal to any land sale, mortgage, or financing arrangement.
2. Buyer Responsibility — Independent Verification
Users and customers are solely responsible for verifying the promoter's or seller's credentials, conducting their own due diligence, and validating all land-related documents before making any purchase or investment decision. This includes (without limitation):
- Title verification and review of the chain of ownership.
- Encumbrance Certificate (EC) inspection at the relevant Sub-Registrar's office.
- Confirmation of layout / planning approvals (HMDA, DTCP, RERA, or other competent authority).
- Verification of the promoter's RERA registration on the respective State RERA portal.
- Physical inspection of the plot and boundary demarcation.
- Independent legal opinion before signing any agreement or making any payment.
- Tax, stamp-duty, and registration implications of the proposed transaction.
3. What Our Platform Provides
The Platform's role is strictly limited to providing technology services such as:
- Tracking payment transactions made by the user.
- Managing EMI schedules and payment history.
- Facilitating instant booking and cancellation requests with third-party sellers / promoters.
- Processing and tracking refund requests raised by the user.
- Providing transaction records, statements, and account-management features.
4. What Our Platform Does NOT Provide
- We do not guarantee, endorse, or verify any promoter, seller, builder, or developer listed or referenced on the Platform.
- We do not guarantee title, ownership, encumbrance status, or marketability of any land or property.
- We do not guarantee government approvals, RERA registration, layout sanction, or any other regulatory clearance for any project.
- We do not verify the authenticity or accuracy of legal documents, deeds, approvals, or representations made by promoters.
- We do not disburse loans, advance credit, act as a lender, or operate as an NBFC or banking institution.
- We do not hold buyer funds in escrow or take fiduciary responsibility for monies transferred between buyers and sellers.
- We do not represent or warrant that any plot will appreciate in value, or that any project will be completed on schedule.
5. Professional Advice Recommended
Customers are advised to independently verify all information and to seek professional legal, financial, and tax advice from qualified advisors before making any purchase, payment, or investment decision based on information available on the Platform.
6. Limitation of Liability
- The Platform, its operators, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive loss arising from any transaction entered into by the user with a third-party promoter, seller, builder, or developer.
- Any dispute, claim, or grievance arising out of a land-related transaction is between the user and the relevant third party. The Platform's liability is limited to the technology services described in Section 3 above.
- Information displayed on listings is provided by sellers/promoters or sourced from public records and is presented "as is" without warranty of any kind.
7. Reporting Discrepancies
If you discover that information shown on the Platform is materially incorrect or misleading, please notify us at support@landemi.in so that we may review and, where appropriate, update or remove the listing. Notification to us does not, by itself, constitute resolution of the underlying transaction dispute — you must also pursue the matter with the relevant promoter / seller and, if needed, the appropriate regulatory authority (RERA, consumer forum, or civil court).
8. Acknowledgement
By using this Platform, you acknowledge that you have read and understood this Legal Disclaimer and agree that the Platform's role is strictly limited as described. You confirm that you will conduct your own independent due diligence before entering into any land-related transaction.
